135 wordsFor the handful of you who’ve never seen a courtroom scene in a movie or television show where the Fifth Amendment is used, it’s essentially the part of the Constitution that protects the convicted from being forced to incriminate themselves, hence the oft-used “right to remain silent” phrase. There are a few other things that the Fifth Amendment protects people from, but as with most things in the Constitution, it’s up to the courts to decide how and when those protections apply in the modern world. Applying centuries-old laws to our modern, technology-driven society can be difficult, and no decision the court makes will be unanimously supported. Such is the case with District Judge Mark Kearny’s recent ruling that people can’t be legally forced to hand over their smartphone passcodes.
